Introduction

Welcome to Onsite Takeoff Estimates ("OTE"). These Terms of Service ("Terms") govern your access to and use of the OTE website, software, services, and applications (collectively, the "Platform"). By using the Platform, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using OTE, you acknowledge that you have read, understood, and agree to be legally bound by these Terms. If you do not agree with any part of the Terms, you may not use the Platform.

2. Description of Services

OTE provides automated construction estimating services for the electrical trade, with plans to expand into additional trades in the future. Users upload drawing sets (PDF files), select relevant pages, and receive automated estimates based on symbol, wiring, and demolition detection.

3. Pricing and Payment

3.1 Pay-Per-Page Pricing

OTE operates on a pay-per-page pricing model. Users are charged based on the number of pages selected for estimating. Separate pricing tiers may apply depending on whether the page includes symbols, wiring, or demolition content. Pricing information will be clearly displayed prior to confirmation and payment.

3.2 Payment Processor

All payments are securely processed via Stripe. By making a payment through the Platform, you agree to be bound by Stripe's terms and policies in addition to OTE's Terms of Service.

4. Estimates and Accuracy

4.1 Average Market Pricing

OTE uses region-specific average market pricing based on available data segmented by state, county, and city. This pricing is compiled from multiple vendors and is intended to provide a general market-based estimate. Users can view pricing by brand and change materials using our search widget, which includes multiple options per item.

4.2 Disclaimer of Accuracy

All estimates generated by OTE are approximations and are not guaranteed to reflect exact material or labor costs. The final estimate is intended for reference purposes only. Pricing fluctuations, local market conditions, vendor-specific deals, and supply chain dynamics can cause actual prices to vary.

4.3 User Responsibility

Users bear full responsibility for reviewing, validating, and applying the estimates generated by OTE. OTE is not liable for any losses, inaccuracies, or issues that result from reliance on estimates generated via the Platform.

5. Refund Policy

All purchases made through OTE are non-refundable, except in cases where:

The Platform experiences a technical error or failure that prevents the delivery of the estimate;
The technical issue is not resolved within a reasonable timeframe after the user has contacted support.

Requests for refunds must be submitted in writing via [email protected]. OTE reserves the right to determine whether a refund is warranted.

6. Use of Export Features

Users may export their estimates into Excel files via built-in tools provided by the Platform. These files are intended for internal business use and must not be redistributed, sold, or misrepresented as final quotations unless approved and modified by a licensed estimator.

7. Privacy and Data Security

Please refer to our Privacy Policy for detailed information on how we collect, use, store, and protect your personal data.

In short:

We do not sell your data.
We do not store your uploaded drawings or estimates unless you explicitly allow us to.
All sensitive payment information is handled directly by Stripe and is not stored on OTE servers.

8. Intellectual Property

All content, software, visual interfaces, logos, and trademarks on the Platform are the property of OTE and are protected under U.S. and international copyright laws. Users may not reproduce, duplicate, or exploit any portion of the Platform without prior written consent.

9. Limitations of Liability

To the fullest extent permitted by law, OTE shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to:

The use or inability to use the Platform;
Inaccuracies in estimates;
User decisions based on data generated by the Platform.

10. Modification of Terms

OTE reserves the right to modify or update these Terms at any time without prior notice. Continued use of the Platform after changes constitutes acceptance of those changes. A timestamped version of the latest Terms will always be made available on the website.

11. Termination

We reserve the right to suspend or terminate access to any user who:

Violates these Terms;
Misuses the Platform;
Attempts to reverse-engineer or tamper with the system.

12. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws principles. All disputes arising from these Terms or the use of the Platform shall be resolved in courts located in Harris County, Texas.
